まあ、確かにブログといえば、ガイアックスだもんな（笑）。ガイアックスといえばブログみたいな。十分成立する、納得。
な、わけないから。
通常、商標を申請する場合、特許事務所に出願書類の作成を依頼し、そこ経由で特許庁に申請書類が提出され、先願権が発生する。通常であれば、先願権が発生した場合、約３年後にはおおかたの商標登録は実現する。昔は、商標登録が実際にされるまでの間は、何が先願されているかを特許庁の紙ベースのドキュメントを確認するしか方法がなく、確認すること自体が結構な作業だと聞いた。それが今はWebで簡単に検索できるようになったのだから、便利な世の中になったんものだ。ただ、、、今でこそ先願のものもWebで確認することができるが、それでもバッチ処理のため、すぐにこのWebにあらわれるわけではない。空白の期間はやはりできてしまうのだ。実は、僕が個人で商標登録申請をした際も、「タッチの差で先願されている場合もあるので、拒絶査定もありえます」と事務所の方に忠告された。先願から、検索エンジンへの登録の期間は、どんどん短縮されるだろうが、今回のガイアックスの先願権も表面化したばかりだと思われる。さて、ガイアックスに期待しましょうか。
ビットバレーなんかもタッチの差の良い例である。わずか2ヶ月差。
